Effective Date: 10 September 2026
Last Updated: 10 September 2026

These Terms of Service ("Terms") govern your access to and use of marketingtusk.com and your purchase, booking, subscription to, or use of services provided by PRANTUSHSHRA MARKETING PRIVATE LIMITED, operating under the brand Marketing Tusk ("Marketing Tusk", "we", "us", or "our").

Please read these Terms carefully before purchasing, booking, subscribing to, or using our services.

By selecting an "I Agree" checkbox or otherwise expressly accepting these Terms in connection with a transaction, you agree to be bound by them.

If you enter into these Terms on behalf of a company or other organisation, you represent that you have authority to bind that organisation.

2. Eligibility

Our services are intended for businesses and professionals aged 18 years or older.

You may use or purchase our services only if:

  • you are at least 18 years old;
  • you have legal capacity to enter into the applicable agreement; and
  • where you act for a company or organisation, you have authority to act on its behalf.

Our services are not intended for minors.

3. Business and Professional Use

Marketing Tusk's services are designed primarily for business and professional purposes.

If applicable law nevertheless classifies you as a consumer for a particular transaction, nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded or limited.

4. Services

Marketing Tusk provides marketing, creative, strategic, digital, branding, communication, advertising, consulting, development, and related professional services.

The precise scope of an engagement may be described in:

  • a quotation;
  • proposal;
  • statement of work;
  • service agreement;
  • order;
  • subscription selection;
  • invoice;
  • written confirmation; or
  • other document agreed between you and Marketing Tusk.

The specific scope agreed for an engagement controls what Marketing Tusk is required to deliver.

Services not included in the agreed scope may require a separate quotation, additional fees, or a revised agreement.

5. Relationship Between These Terms and Service Agreements

These Terms provide the general terms governing your relationship with Marketing Tusk.

A particular engagement may also be governed by an accepted proposal, order, statement of work, service agreement, or other written commercial terms.

If an expressly agreed written term for a specific engagement conflicts with these general Terms, the specific written term will control for that engagement to the extent of the conflict.

6. Orders, Bookings and Acceptance

A service becomes binding when the applicable transaction or agreement is accepted through the process presented by Marketing Tusk.

Where our website provides an I Agree checkbox, you must affirmatively select that checkbox before completing the applicable transaction.

You should review these Terms and any applicable proposal, pricing, subscription information, refund terms, and service scope before accepting.

Marketing Tusk may retain records relating to acceptance, including the applicable Terms version, date and time of acceptance, and transaction or customer reference.

7. Client Responsibilities

You are responsible for providing information, materials, instructions, approvals, access, and cooperation reasonably required for Marketing Tusk to perform the agreed services.

You are responsible for ensuring that information and instructions you provide are accurate and that you have the necessary rights and authority to provide any materials supplied to us.

You must not instruct Marketing Tusk to use materials, data, content, advertising claims, or other information in a manner that violates applicable law or third-party rights.

Where your delay in providing required information, materials, access, or approval affects delivery, corresponding timelines may also be affected.

8. Fees and Payments

You agree to pay the fees stated at checkout, in the applicable quotation, proposal, invoice, subscription, service agreement, or order.

Marketing Tusk may accept payment through methods or providers including:

  • Razorpay;
  • Stripe;
  • PayPal;
  • Cashfree;
  • UPI; and
  • bank transfer.

Payment processing may be performed by third-party payment providers under their own terms and privacy practices.

Any taxes, duties, or similar charges will be handled as stated in the applicable transaction documentation and as required by law.

Failure to make an amount due may result in delay or suspension of the affected services, subject to the applicable agreement and law.

9. Recurring Subscriptions and Retainers

Marketing Tusk may offer recurring services on:

  • monthly;
  • quarterly; or
  • annual

billing cycles.

Where a service is described as automatically renewing, it will continue to renew for the applicable billing period until cancelled in accordance with these Terms or the applicable service agreement.

Before purchasing an automatically renewing service, you should review:

  • the applicable price;
  • billing frequency;
  • renewal arrangement;
  • service scope; and
  • cancellation terms.

Unless otherwise stated in the applicable agreement, cancellation prevents future renewal after the end of the then-current billing period.

10. Seven-Day Free Trial

Marketing Tusk may offer a 7-day free trial for eligible services.

The free trial does not automatically convert into a paid subscription.

At the end of the trial, you must take the required affirmative action to purchase or activate a paid service if you wish to continue with the applicable paid offering.

Availability of a free trial may depend on the particular service or offer.

11. Cancelling a Subscription

You may request cancellation of an active subscription by emailing:

connect@marketingtusk.com

Unless a different arrangement is stated in the applicable service agreement, cancellation becomes effective at the end of the current billing period.

You remain entitled to receive the applicable subscribed service through the effective cancellation date, subject to these Terms and the agreed service scope.

Any mandatory cancellation rights available under applicable law remain unaffected.

12. Refunds

Refund eligibility depends on whether Marketing Tusk has begun performing the agreed services and on any applicable written service terms.

Before work begins

A refund may be available where cancellation occurs before Marketing Tusk begins performing the applicable services, subject to the terms of the relevant transaction or service agreement.

After work begins

Once Marketing Tusk has begun performing the agreed services, payments are generally non-refundable.

A partial or other refund may nevertheless be considered on a case-by-case basis where Marketing Tusk determines that the circumstances justify one.

Nothing in this section excludes any refund, cancellation, or other remedy that must be provided under applicable law.

Where a separate Refund or Cancellation Policy applies to your purchase, that policy forms part of the applicable transaction terms.

13. Project Timelines

Any project schedule or delivery date will be determined by the applicable service scope, proposal, or written agreement.

Timelines may depend on timely:

  • provision of information;
  • provision of materials;
  • access to systems;
  • approvals;
  • feedback;
  • payments; and
  • other actions required from the customer.

Unless expressly stated as a guaranteed contractual deadline, an estimated delivery date is an operational target and may be adjusted where circumstances affecting performance reasonably require it.

14. Revisions and Scope Changes

The number and nature of revisions included in an engagement will be determined by the applicable proposal, package, order, or service agreement.

Requests outside the agreed scope may require:

  • additional fees;
  • revised timelines;
  • a new quotation; or
  • a separate scope of work.

Marketing Tusk is not required to provide unlimited revisions unless expressly agreed in writing.

15. Customer Materials

If you provide text, images, trademarks, logos, data, documents, files, credentials, instructions, or other materials for use in providing the services, you represent that you are authorised to provide and use those materials for the relevant purpose.

You grant Marketing Tusk permission to use such materials only as reasonably necessary to perform the services and administer the engagement.

You remain responsible for the legality, accuracy, and rights associated with materials you provide.

16. Intellectual Property

Marketing Tusk and third parties may own intellectual property used in connection with our website, processes, services, tools, templates, methodologies, designs, software, content, and other materials.

The ownership or licence terms applicable to custom client deliverables will be determined by the applicable proposal, service agreement, statement of work, or other written agreement for the project.

Nothing in these Terms transfers intellectual property ownership beyond what is expressly agreed for the relevant engagement.

You may not copy, reproduce, distribute, commercially exploit, or create unauthorised derivative works from Marketing Tusk materials except where permitted by law or expressly authorised by us.

17. Third-Party Services and Platforms

Our services may involve or depend on third-party platforms, software, advertising systems, hosting providers, payment providers, social networks, communication platforms, analytics systems, or other external services.

Third-party services may be governed by their own:

  • terms;
  • policies;
  • technical restrictions;
  • pricing;
  • algorithms;
  • advertising rules; and
  • availability.

Marketing Tusk does not control changes made independently by third-party platforms.

Where a third-party platform changes its rules, technology, availability, algorithm, pricing, or functionality, adjustments to the affected Marketing Tusk service may be necessary.

18. No Guaranteed Marketing or Commercial Results

Marketing, advertising, branding, growth, communication, and strategic services involve factors outside Marketing Tusk's direct control.

Unless a specific outcome is expressly guaranteed in a signed agreement, Marketing Tusk does not guarantee any particular:

  • number of leads;
  • sales volume;
  • revenue;
  • conversion rate;
  • website traffic;
  • advertising performance;
  • search ranking;
  • social-media reach;
  • engagement;
  • fundraising outcome;
  • investment;
  • investor response;
  • business valuation; or
  • other commercial result.

Any forecasts, targets, projections, estimates, strategies, or expected outcomes are inherently subject to uncertainty.

This section does not excuse Marketing Tusk from performing services that it has expressly agreed to provide.

19. Acceptable Use

You must not use our website or services to:

  • violate applicable law;
  • infringe intellectual-property or other third-party rights;
  • transmit malicious software;
  • interfere with the operation or security of our website or systems;
  • gain unauthorised access to systems or information;
  • impersonate another person or organisation;
  • submit fraudulent or materially misleading information;
  • facilitate unlawful, abusive, deceptive, or fraudulent conduct; or
  • misuse Marketing Tusk services in a manner materially inconsistent with their intended business purpose.

20. Suspension or Termination

Marketing Tusk may suspend or terminate an affected service where reasonably necessary because of:

  • material non-payment;
  • material breach of the applicable agreement;
  • unlawful use;
  • fraud or abuse;
  • security risk;
  • misuse of our systems; or
  • a legal or regulatory requirement.

Where reasonably practicable and appropriate, we may provide notice and an opportunity to remedy a remediable breach before termination.

Any consequences of termination for fees, deliverables, data, or continuing obligations will be determined by these Terms and the applicable service agreement.

21. Privacy

Our processing of personal data is described in the Marketing Tusk Privacy Policy.

Our use of cookies and similar website technologies is described in our Cookie Policy.

Acceptance of these Terms is contractual assent. It should not be interpreted as consent to every processing activity described in the Privacy Policy.

Where separate consent is required, including for optional marketing or certain cookies and tracking technologies, Marketing Tusk obtains that choice separately.

22. Electronic Communications

You agree that communications relating to an enquiry, transaction, subscription, service, acceptance, cancellation, or other business relationship may be provided electronically, including by email.

Promotional email or WhatsApp communications are handled separately from necessary transactional or service communications.

23. Website Availability

We may update, maintain, modify, or temporarily restrict access to parts of marketingtusk.com.

We do not guarantee that the public website will be uninterrupted or error-free at all times.

This does not affect any specific service obligation expressly agreed in a service agreement or order.

24. Disclaimers

Marketing Tusk will provide the services described in the applicable agreement.

Except for commitments expressly made in writing and any rights or warranties that cannot lawfully be excluded, the website and general informational materials are provided without additional guarantees concerning specific commercial results.

Nothing in these Terms excludes responsibility for services that fail to meet an express contractual commitment or any obligation that cannot lawfully be excluded.

25. Liability

Nothing in these Terms excludes or limits liability to the extent that such liability cannot legally be excluded or limited.

Any additional limitation of liability, liability cap, exclusion of particular categories of loss, indemnity, or risk allocation applicable to a specific engagement must be stated in the applicable service agreement or another legally effective agreement.

Where no valid contractual limitation applies, liability will be determined in accordance with applicable law.

26. Mandatory Rights

Nothing in these Terms is intended to waive, restrict, or exclude any statutory right, remedy, warranty, cancellation right, refund right, or other protection that applicable law does not permit the parties to exclude.

If a provision of these Terms conflicts with a mandatory legal requirement applicable to you or the relevant transaction, the mandatory requirement will prevail to the extent of that conflict.

27. Changes to Services

Marketing Tusk may change or discontinue website functionality or general service offerings from time to time.

Any change affecting an already purchased service remains subject to the specific agreement governing that engagement and applicable law.

28. Changes to These Terms

We may update these Terms to reflect changes in our services, commercial practices, technologies, or legal requirements.

The updated version will state its effective or last-updated date.

Where a change materially affects an existing contractual relationship, we will provide additional notice or obtain renewed acceptance where required by the applicable agreement or law.

Material changes will not automatically replace contrary terms of an existing signed service agreement unless the parties validly agree otherwise.

29. Governing Law and Disputes

These Terms and each transaction remain subject to the laws that validly apply to the relevant agreement.

Any governing-law, court-jurisdiction, arbitration, mediation, or other dispute-resolution arrangement expressly contained in an applicable signed service agreement will apply to that engagement to the extent legally effective.

Where no such provision has been agreed, governing law, jurisdiction, and available remedies will be determined under applicable law.

Nothing in this section deprives a person of a mandatory right or forum that cannot lawfully be waived.

30. Severability

If a provision of these Terms is determined to be invalid or unenforceable, that provision will be applied to the maximum extent legally permitted, and the remaining provisions will continue in effect where legally possible.

31. No Waiver

A failure or delay in exercising a contractual right does not by itself constitute a waiver of that right.

32. Entire Agreement

These Terms, together with the applicable:

  • proposal;
  • quotation;
  • order;
  • statement of work;
  • subscription terms;
  • service agreement;
  • refund or cancellation policy; and
  • other expressly incorporated terms

form the agreement governing the relevant service.
